SC orders release of NC leader Khadka

Kathmandu, April 16: The Supreme Court has issued an order to release Nepali Congress leader and former minister, Dipak Khadka, on Thursday. Khadka was arrested on charge of money laundering.

A division bench of Acting Chief Justice Sapana Pradhan Malla and Justice Shreekant Paudel issued such order in response to a habeas corpus writ petition filed by Khadka’s spouse, Binita Thapa.

“Khadka’s detention is not legitimate nor follows a due process. The arrest warrant against him and extension of detention do not meet legal provision,” Justices duo said, arguing the investigation into Khada’s property could be forwarded even by keeping him out of detention.

However, Khadka is required to get permission from the concerned court in case of foreign visit.

If the person sued fails to disclose the source of property, the Inland Revenue Department could determine and impose the tax on the amount of property with undisclosed source as per law, the order added.

The Central Investigation Bureau of Nepal Police had arrested former minister Khadka two weeks back in connection with money laundering after a the letter from Revenue Investigation Department.
